These Terms and Conditions explain the rules that apply when purchasing products through Morarte Shop. They are intended to be clear and should be read before placing an order.
Scope and acceptance
These Terms and Conditions apply to purchases made through www.morarteshop.com. By submitting an order, the customer confirms that they have read and accepted these Terms. The customer must be at least 18 years old or have the permission and involvement of a parent or legal guardian. By placing an order on this website, you confirm that you are at least 18 years of age or, if you are under 18, that you have obtained the consent of a parent or legal guardian to make the purchase. If we become aware that an order has been placed without the required consent, we reserve the right to cancel the order and refund any payment received.
Products and artwork
Morarte Shop offers art-inspired accessories, prints and related products featuring artwork associated with the Morarte brand. Product photographs and descriptions are prepared carefully, but colours may appear slightly different because of screen settings, materials and printing processes. Minor colour or positioning variations that are normal for the production method do not constitute a defect.
Some designs may be offered as limited editions. Where an edition limit applies, it will be stated on the relevant product page. The edition relates to the design and does not transfer any copyright or reproduction rights to the buyer.
Orders and contract formation
The customer is responsible for selecting the correct product, device model, size, colour and delivery information. The website will display an order summary before payment. An automated acknowledgement confirms receipt of the order but does not necessarily mean that it has been accepted. The sales contract is formed when Morarte Shop confirms acceptance or begins fulfilment.
Morarte Shop may refuse or cancel an order before dispatch where a product is unavailable, information or pricing is clearly incorrect, payment is not authorised, fraud is suspected, or delivery to the stated destination is not possible. Any amount paid for a cancelled order will be refunded using the original payment method.
Prices, taxes and payment
Prices are shown in the currency indicated on the website and include applicable taxes where stated. Delivery charges, if any, are shown before the customer confirms the order. Customers outside the relevant tax or customs area may be responsible for import duties, local taxes or handling charges imposed by their country.
Payment is made through the methods shown at checkout. Payment providers process transaction data under their own terms and security procedures. The customer confirms that they are authorised to use the selected payment method.
Production, shipping and delivery
Many Morarte Shop products are produced after an order is placed. Estimated production and delivery times are shown on the website or during checkout. These are estimates rather than guaranteed dates and may be affected by demand, destination, customs, courier delays or events beyond reasonable control.
The customer must provide a complete and accurate delivery address. If a parcel cannot be delivered because the address is incorrect, access is unavailable, or the parcel is not collected, the customer may be responsible for reasonable additional delivery costs. Risk passes to the consumer when the goods are physically received by the customer or a person nominated by them, except where the customer independently appoints a carrier not offered by Morarte Shop.
Cancellation and return
Consumers in the European Union normally have the right to withdraw from an online purchase within 14 calendar days from receipt of the goods, without giving a reason. To exercise this right, the customer must send a clear statement to info@morarteshop.com before the period expires and return the goods in accordance with the instructions provided.
The customer may be responsible for the direct cost of returning ordinary goods unless Morarte Shop agrees otherwise. Returned goods should be unused and handled only as necessary to establish their nature, characteristics and functioning. A reduction may be made where the value has decreased because of handling beyond what would be permitted in a shop.
All Morarte Shop products are manufactured individually following the customer’s order. Production only begins once an order has been accepted and payment has been successfully processed.
Customers may request the cancellation of an order only if production has not yet commenced. Once production has begun, it may no longer be possible to cancel the order, as materials and manufacturing resources will already have been allocated specifically for that order.
Where a product has been manufactured according to the customer’s specifications or has been clearly personalised, the statutory right of withdrawal may not apply in accordance with Article 103(c) of the Spanish Consumer Protection Act (Real Decreto Legislativo 1/2007).
Where the statutory right of withdrawal applies under applicable consumer protection legislation, nothing in these Terms and Conditions shall limit or exclude that right.
This policy does not affect the customer’s statutory rights in relation to defective, damaged or non-conforming products. All products remain covered by the applicable legal guarantee under Spanish law.
Damaged, defective or incorrect products
The customer should inspect the order after delivery. If an item arrives damaged, defective or different from what was ordered, the customer should contact info@morarteshop.com as soon as reasonably possible, preferably within 14 days, quoting the order number and attaching clear photographs. This notification period does not reduce any mandatory consumer rights.
After reviewing the issue, Morarte Shop will provide an appropriate remedy in accordance with applicable law, which may include repair, replacement, price reduction or refund. Customers should not return an item until return instructions have been provided.
Legal guarantee
Goods supplied to consumers are covered by the mandatory legal guarantee of conformity applicable in Spain and, where relevant, the consumer’s country of residence. For purchases governed by Spanish law, new goods are generally covered for three years from delivery. The guarantee applies where goods do not conform to the contract, but not to normal wear, accidental damage, misuse, improper care, unauthorised modification or damage caused by incompatible equipment.
Intellectual property
All artwork, photographs, graphics, logos, product designs, text and other website content are owned by Morarte Shop, the artist or the relevant rights holder and are protected by intellectual-property law. Purchasing a product transfers ownership of the physical item only. It does not grant permission to copy, scan, reproduce, distribute, modify or use the artwork or design commercially.
Liability and events beyond control
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights. Subject to that rule, Morarte Shop is not responsible for indirect or unforeseeable loss, or for delay or failure caused by events reasonably beyond its control, such as transport disruption, customs delays, natural events, industrial disputes, failures of external networks or official restrictions.
Law, complaints and contact
These Terms are governed by Spanish law, without depriving a consumer resident elsewhere of any mandatory protection provided by the law of their country. Any dispute may be brought before the competent courts determined by consumer law, normally including the courts of the consumer’s place of residence.
Questions, complaints, cancellation notices and return requests should be sent to info@morarteshop.com. Please include the order number and enough information for us to identify and resolve the matter.
